Terms of Service
These Terms of Service ("Terms") are an agreement between you and Power Era Servicios, S.C. ("PowerEra", "we", "us"), with its address at Calle Vasco de Quiroga 3900, Torre A, Piso 10 B, Col. Santa Fe Cuajimalpa, Alcaldía Cuajimalpa de Morelos, C.P. 05348, Ciudad de México, México. They govern your use of Waykee, including the web application, mobile and desktop apps, the API, and the Waykee connector for ChatGPT and Claude (the "Connector") (together, the "Service"). By creating an account or using the Service you accept these Terms. If you use the Service for an organization, you accept them on its behalf and confirm you are authorized to do so.
1. Accounts
- You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account, including actions an AI assistant performs through the Connector after you authorize it.
- You must be at least 16 years old, or the age of majority where you live if higher, to use the Service.
- Tell us right away at support@powerera.com if you suspect unauthorized access.
2. Your content
You keep all rights to the content you put into Waykee ("Your Content"). You give us a limited license to host, copy, process and display Your Content only to provide and secure the Service for you and the people you share it with. We do not use Your Content to train AI models. You are responsible for having the rights to Your Content and for what you share.
3. AI features and the Connector
- Waykee includes AI features (such as AI agents and semantic search) and lets you connect third-party assistants like ChatGPT and Claude. AI output can be inaccurate or incomplete; review it before relying on it, especially for legal, financial, medical or safety decisions.
- When you connect an assistant, it can read and act on your Waykee data within your permissions and the tools described in the Connector documentation, including creating or updating tasks, documentation and messages when you ask it to. You can revoke this access at any time.
- Your use of ChatGPT, Claude or other third-party services is governed by their own terms and privacy policies. We are not responsible for those services.
4. Acceptable use
You agree not to:
- break the law or infringe the rights of others;
- upload malware, or attempt to access accounts, data or systems you are not authorized to access;
- probe, scan or test the vulnerability of the Service, or bypass its security or rate limits, without our written permission;
- use the Service to send spam or to harass, deceive or harm anyone;
- resell or provide the Service to third parties except as your plan allows; or
- use the Service to build a competing product by copying its features or content.
5. Plans, fees and cancellation
Some features require a paid plan. Prices and limits are shown when you subscribe. Paid plans renew automatically for the same period unless you cancel before renewal; payments are processed by Stripe. Fees already paid are non-refundable except where the law requires otherwise. We may change prices with at least 30 days' notice before your next renewal.
6. Our rights
The Service, including its software, design and trademarks, belongs to PowerEra and its licensors. Some Waykee components are published under open-source licenses; those licenses govern that code. These Terms do not grant you any right to our trademarks.
7. Suspension and termination
You can stop using the Service and request deletion of your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users; where reasonable, we will give notice first. After termination you may request an export of Your Content for 30 days, after which it may be deleted as described in the Privacy Policy.
8. Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service or any AI output will be uninterrupted, error-free or accurate.
9. Limitation of liability
To the extent permitted by law, PowerEra will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to the Service is limited to the amounts you paid us for the Service in the 12 months before the claim, or USD 100 if you have not paid anything.
10. Indemnity
You will defend and indemnify PowerEra against third-party claims arising from Your Content or your breach of these Terms.
11. Changes
We may update these Terms. We will post the new version here with its effective date and, for material changes, notify you by email or in the app at least 15 days before they apply. If you keep using the Service after that, you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the United Mexican States. Any dispute will be submitted to the competent courts of Mexico City, without prejudice to your rights as a consumer before Mexico's Federal Consumer Protection Agency (Profeco) or to the mandatory consumer protections of the place where you live.
